Looks like AGjOBS bill has good chance of passing. Does anyone know what the definition of agricultural worker is ?
Could one by considered agricultural worker if they are in landscaping business ? what about in agricultural sales.
We are about to see creation of huge black market for documents claiming someone is farmer if this rule is passed.
Can one be illegally working as Ag worker while on H1 ? :)

One of my minor dependents appears to have been out of status due to non renewal of their H4 visa. We thought that like the original application, dependents were covered by my renewal, found out too late that this is incorrect. Since then we have obtained renewals and the dependent in question now has an approved H-4 status, plus pending 485 and advanced parole.
I have been told though that time out of status is not counted against minors. Is this true?
Is there any risk in travelling out of the country to get visa stamped and returning? I understand this resets the clock. Can the embassy look into the history, find out that previous issue and deny the H-4 stamping because of it?
I am very discouraged by this long drawn out process. Any information would be appreciated.
PS: The minor in question just turned 14 years old. Could this be the reason?

My H1B 6th Year expires August 2007 and need to apply for 7th year extension.
The below are options I read in murthy.com
1. Labor pending or approved before 365 days of H1B 6th Year expires
2. I140 Approved
Applied for PERM labor in April 2007 and still in pending status (First option ruled out)
After looking at July 2007 Visa Bulletin immediately Applied for I140 using Substitution Labor . Assuming that I can work on EAD.
And because of Revised Visa Bulletin I could not apply for I485.
Can I apply for 7th year extension based on I140 receipt (using Labor substitution)?
If no to the above question and suppose if my PERM labor is approved some time in July and if the USCIS start again the Premium for I140 Can I apply for another I140 from same employer?

Politico reports that he is in favor of a legalization program that will allow "citizen boards" (similar to the draft boards of an earlier era) to determine whether undocumented immigrants deserve to stay in the US. No, there is no form to fill out. Just write a letter with all the pertinent information (Alien #, etc) to identify your case. Include a copy of the approved I-140 with the letter.

A federal judge in Phoenix on Wednesday blocked key provisions of Arizona's controversial immigration law from taking effect as scheduled Thursday, granting in part an injunction requested by the Obama administration.
U.S. District Judge Susan Bolton ruled that the injunction would apply to the portion of the state law that requires police to try to determine the immigration status of a person they arrest, stop or detain while enforcing other laws if they reasonably suspect the person is in the United States illegally.
In a lawsuit filed against Arizona, the Obama administration said the law was unconstitutional and warned that the provision would result in racial profiling and harassment of U.S. citizens, legal immigrants and foreign visitors.
Bolton said in her ruling that it was "not in the public interest" for Arizona to enforce a provision that preempts federal enforcement of immigration law.

My Son is in India and will be traveling back to US on 1st September 2009 and His passport validity expires on 28th February 2010. Is it necessary for us to renew his passport while he is in India it self for him to enter into US?
Also our H1B validity expires by 14th January 2010.

I am currently using my EAD and working for a company remotely from my house. I also have a Permanent Resident Status in Canada. I can work remotely from Canada and my company will not have any objections to it.
Since I am on 485/EAD can I work for a US company and be on their pay roll and live in Canada? What are the ramifications?
Please advise!
Once you are not in US It does not matter. But as for as EAD or H1 It does not matter. Same rules apply as any other country. You have to present in US to apply and get approval for AP.
Taxes issues may be different.

It will great help if some body can help regarding this.
I had my H1B from A Company,Recently i have moved to B Company where i was asked to go to UK for Business purpose.I have yet to have stamping from B Company.I still have valid visa till end of next year from Company A name stamping in the passport.Will there be any issues for comming back from UK without having stamping.

Secondly, you don't need a new stamp as your old stamp is still valid but, make sure you carry all the H1 paperwork from your new company.

I had posted some queries previously and thanks to all who took time to respond.
As I had said before , I have an admission to study for my MBA outside US for one year. Here is the latest update:
I was thinking I will get a one year leave abscence from my employer ( advt on the website), but apparently they dont support studies as part of the deal.
So i am out of luck;
Considering my situation what do you gurus recommend.
How can I leave US yet maintain my GC process.
My I-140 is approved
Situation:
Spouse in school Full time Studies on I-485 pending. ( entered on F1 then converted to I485..... so going back to F1 is impossible)..
I want her status to be preserved.
My thought:
Resign from my company when I need to leave. Convince them that I will return. Maintain no ties with the company for one year..basically can be compared to being jobless for one year.
and then get a letter that a future similar job will be available with the same Co. ( that sponsored my GC)...
Is this feasible ./practical?
